Remote Support Terms and Conditions

As part of the services you have subscribed for with JC IT Solutions, we are pleased to attempt to, at your instance, order and request, fix issues arising from common personal use software (excluding hardware) relating to our affiliate or licensor service through a remote connection to your computer. Please understand that by requesting such assistance, you agree to provide JC IT Solutions Support with access to and control of your computer as reasonably required to perform the requested services. By accepting a remote session from us, you agree to the following terms/disclaimers, of which you acknowledge yourself to be fully aware:

Your Responsibilties

  • You expressly warrant and confirm that you have the full capacity and authorization, to bind yourself/your employer/your organization to these terms and disclaimers.
  • You expressly warrant and confirm that you will close any confidential files that you may have been working on, before allowing remote access to your computer.
  • You confirm that you will remain seated at your desktop throughout the entire duration of the remote session.
  • You accept full risk and responsibility for any changes to the contents or system settings of your computer or that of your employer and/or organization.
  • The remote session may be cut short, delayed, rescheduled and/or terminated as a result of matters outside of our reasonable control.
  • You shall keep JC IT Solutions indemnified against all claims, demands, proceedings, losses, damages and/or costs of whatsoever nature and howsoever arising, that may be suffered by JC IT Solutions Support and/or yourself, your employer or your organization as the case may be, as a result of JC IT Solutions Support agreeing or conceding to your request(s).

Back-ups

By accepting a remote session from us, you warrant that you are aware of, and that you have:

  • Ensured that you made a full backup of all data on your computer systems prior to allowing JC IT Solutions Support to access your computer or the computer of your employer and/or organization.
  • JC IT Solutions Support will not make any copy of your files or retain any information accessed during the remote session.
  • JC IT Solutions Support does not guarantee or warrant that the remote session:
    – will be secure or private, when you allow our JC IT Solutions Support to connect to your computer.
    – will meet your needs or requirements, fit your purposes, or will be error-free.

Limitation of Liability

JC IT SOLUTION’S SUPPORT, ITS AFFILIATES OR LICENSOR ACCEPTS NO LIABILITY WHATSOEVER FOR OR ARISING FROM PROVISION OF THE REMOTE ACCESS SESSION INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR LINKING AND/OR  VIEWING ANY OF YOUR CONTENT, OR YOUR COMPUTER SYSTEM PERFORMANCE. JC IT SOLUTIONS SUPPORT WILL NOT BE LIABLE, VICARIOUSLY OR AT ALL, TO YOU/YOUR EMPLOYER/ORGANISATION FOR ANY LOSS, COST, EXPENSE OR DAMAGE INCURRED BY YOU/YOUR EMPLOYER OR ORGANIZATION INCLUDING BUT NOT LIMITED TO (I) ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES AS A RESULT OF OR ARISING FROM THIS REMOTE SESSION, OR (II) ANY DAMAGES RESULTING FROM LOSS OF USE, DATA OR PROFIT. BY ACCEPTING THESE TERMS, YOU ACKNOWLEDGE YOURSELF/YOUR EMPLOYER AND/OR YOUR ORGANIZATION TO BE FULLY AWARE OF WHAT IS HEREIN SET OUT AND YOU ACKNOWLEDGE THAT YOU/YOUR EMPLOYER AND/OR YOUR ORGANIZATION UNDERSTANDS THE FULL FORCE AND EFFECT HEREOF AND THAT SAME HAS BEEN EXPLAINED TO YOU/YOUR EMPLOYER AND/OR YOUR ORGANIZATION.
